Terms of Use
These terms govern your use of ContentSling. ContentSling is a content workspace: it lets you (the "customer") organize your own content and publish it to the social media accounts you choose to connect. ContentSling is a tool that you direct. You are responsible for the accounts you connect, the content you publish, and your compliance with each connected platform's own rules. By using ContentSling you agree to these terms. ContentSling is operated by Ryan Collier, a sole proprietor based in Yellowknife, Northwest Territories, Canada.
1. What ContentSling is (and is not)
ContentSling provides a service: a place to organize content and send it, through official platform APIs, to the accounts you connect. ContentSling does not create your content, does not own it, and does not act on any account except the ones you connect and authorize, doing only what you instruct. ContentSling is not affiliated with, endorsed by, or acting on behalf of any of the platforms it can connect to.
2. Your account
You are responsible for your ContentSling login and for everything done under it. Keep your credentials secure. Each customer's workspace, connected accounts, content, and obligations are their own; one customer is never responsible for another's, and ContentSling does not manage or assume any customer's obligations to any third party.
3. Connecting platforms is your responsibility
ContentSling publishes to third-party platforms (for example TikTok, Instagram, Facebook, and YouTube) only through those platforms' official APIs. It is your responsibility to:
- keep the social accounts you connect in good standing, and follow each platform's terms, community guidelines and content policies;
- read, accept, and comply with each platform's own terms of service, developer and API terms, community guidelines, and content and copyright policies;
- ensure the way you use each platform through ContentSling is permitted by that platform.
Your relationship with each platform is between you and that platform, and is governed by that platform's terms. ContentSling is not a party to that relationship, does not control those platforms, and is not responsible for your compliance or non-compliance with their rules. This includes, without limitation, any decision by a platform to review, limit, suspend, or terminate your access, your account, your app, or your content. If you do not follow a platform's API, developer, content, or copyright policies, that is your responsibility, not ContentSling's.
4. Your content and your rights
You are solely responsible for the content you publish through ContentSling. You represent and warrant that, for everything you publish:
- you own it, or you hold all rights, licenses, consents, and permissions necessary to publish it and to grant each connected platform the license that platform's terms require;
- it does not infringe anyone's intellectual-property, privacy, publicity, or other rights, and is not unlawful;
- publishing it does not violate any law or any connected platform's rules.
ContentSling does not review, endorse, own, or claim any rights in your content. It publishes what you instruct it to publish, to the accounts you control. Where your content includes work created by others that you are licensed to use, you are responsible for holding a license broad enough to cover that use and for honoring any attribution or other conditions attached to it.
5. Storing your content, and keeping your own copies
To schedule a post, ContentSling has to hold the file. Images and video you upload are stored on ContentSling's infrastructure so that the connected platforms can fetch them at the moment of publishing, and so you can see them on your calendar beforehand. They stay available to you while your account is active.
Keep your own copies. ContentSling is a scheduling tool, not a backup service or an archive. You are responsible for holding your own copies of anything you upload. Do not rely on ContentSling as the only place a file exists.
How long content is kept:
- While your account is active: your content and media stay, and are not deleted on a schedule.
- After you close your account, or ask for deletion: your content and media are deleted.
- After a trial ends without a subscription: the workspace and its media may be deleted after a period of inactivity.
- If a subscription lapses: access may be suspended immediately, and content may be deleted after a period of inactivity. Export anything you need before cancelling.
There are limits on what can be uploaded, set by what the receiving platforms accept: 10 MB per image, 4 images per post, and 150 MB per video. Files above these limits are rejected at upload rather than failing later at publishing time.
Media is served to the platforms over the public internet, because that is the only way most of them will accept a file. This is explained in the privacy policy under how content is stored.
6. Acceptable use
You agree not to use ContentSling to:
- break any law, or infringe or misappropriate anyone's rights;
- publish content that violates a connected platform's terms, or that is spam, deceptive, or abusive;
- abuse platform rate limits, or interfere with or attempt to break ContentSling's or any platform's services;
- impersonate any person or organization, or misrepresent your affiliation.
7. Service provided "as is"
ContentSling is provided "as is" and "as available," without warranties of any kind, express or implied. ContentSling does not warrant uninterrupted or error-free operation, that any post will be delivered or accepted by a platform, or that connected platforms or their APIs will remain available or unchanged.
8. Limitation of liability
To the maximum extent permitted by law, ContentSling and its operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, reach, or goodwill, arising out of or relating to your use of ContentSling, your content, your relationship with any platform, or any action a platform takes regarding your account or content.
9. Indemnity
You agree to indemnify and hold harmless ContentSling and its operator from any claim, demand, loss, or expense arising out of the content you publish, your use of ContentSling, your breach of these terms, or your violation of any law or of any platform's or third party's terms or rights.
10. Suspension and termination
You may stop using ContentSling at any time. ContentSling may suspend or terminate access for any breach of these terms or where required for legal or security reasons.
11. Changes
These terms may be updated. Material changes will be reflected here with a new "last updated" date. Continued use after a change means you accept it.
12. Governing law
These terms are governed by the laws of the Northwest Territories and the federal laws of Canada that apply there.
